드레이크(Drake)와 그의 소속사 캐쉬 머니 레코드(Cash Money Records)가 무단 샘플링으로 고소당했다. 문제가 된 곡은 드레이크의 [Nothing Was The Same] 수록곡인 "Pound Cake/Paris Morton Music 2".

재즈 뮤지션 지미 스미스(Jimmy Smith)의 보컬을 허락 없이 사용했다는 게 지미 스미스 재단 측의 얘기다. 재단 측은 드레이크와 레이블이 스미스의 1982년도 곡인 "Jimmy Smith Rap"을 무단으로 사용했으며, 라이너 노트에도 표기하지 않았다는 걸 문제 삼았다.   

이에 스미스 재단은 30만 달러(한화 약 3억 1천만 원) 이상의 손해배상을 요구했다. 아직 드레이크 측에서 공식적인 발언은 없는 상태다.

한편, 문제가 된 부분은 아래와 같다.

"Good God Almighty. Like back in the old days. You know, years ago, they had the A&R men to tell you what to play, how to play it and whether it’s Disco and Rock, but we just went in the studio and we did it. We had the champagne in the studio, of course, compliments of the company, and we just laid back and did it. So we hope you enjoy listening to this album half as much as we enjoyed playing it for you, because we had a ball. Only real music is gonna last. All the other bullshit is here today and gone tomorrow."
